Welcome to The Flights Guru  referred to as "the Company," "we," "us," or "our"). This User Agreement ("Agreement") governs your access to and use of our website (www.theflightsguru.in), our mobile applications, and any travel booking services facilitated by our human travel specialists via phone, email, or WhatsApp (collectively referred to as the "Platform").

Please read this Agreement carefully. By accessing our Platform, submitting an inquiry, or finalizing a travel booking, you acknowledge that you have read, understood, and unreservedly agree to be bound by these terms. If you do not accept this Agreement in its entirety, you must immediately discontinue using our Platform and services.

1. Legal Capacity and Platform Eligibility

By entering into this Agreement, you declare, warrant, and represent that:

• You are a natural person of at least 18 years of age and possess the legal authority to form a binding contract under the Indian Contract Act, 1872.
• All information you supply to our Platform or our travel specialists is 100% true, accurate, current, and complete.
• If you are booking flights or holiday packages on behalf of third-party passengers, you have obtained explicit legal authorization from each individual traveler to share their data and bind them to this Agreement.

2. Our Role as an Intermediary Marketplace

A. Service Facilitator Only

The User acknowledges that The Flights Guru operates strictly as an intermediary travel marketplace. We provide digital systems and human expert consultation to connect you with primary third-party service providers, including airlines, hotels, resort properties, rail operators, cruise lines, and local tour management companies (collectively referred to as "Travel Providers").

B. Independent Provider Rules

We do not own, operate, or maintain any aircraft, hotel properties, vehicles, or cruise liners. Therefore, the ultimate contract for service delivery exists directly between you and the respective Travel Provider. The Flights Guru is not legally responsible for airline schedule disruptions, flight cancellations, luggage damage, hotel overbookings, or any operational shortfalls. Your remedies in these events fall entirely under the Travel Provider’s specific Contract of Carriage and internal terms.

3. Account Security and Proper Platform Use

If you create an account on our Platform, you are solely responsible for maintaining the confidentiality of your login credentials (username and password). You agree to accept liability for all activities that occur under your account.

You explicitly agree that you will not use this Platform to:

• Make speculative, false, or fraudulent reservations in anticipation of market demand.
• Deploy automated scrapers, bots, indexing spiders, or data mining tools to monitor or copy our proprietary search layout, flight rates, and content.
• Circumvent or bypass our security firewalls, payment gateways, or network access systems.

4. Ticketing and Booking Conditions

A. Precision of Passenger Information

For all flight bookings, the User bears absolute responsibility for ensuring that passenger names match their government-issued passports or national IDs exactly. Airlines do not permit name modifications once a Passenger Name Record (PNR) is generated. Minor spelling corrections are subject to the operating airline’s approval and will incur substantial supplier re-ticketing fees.

B. Price Variations

All quotes are dynamic and subject to real-time seat availability within global airline reservation networks. A price is only guaranteed and locked once your full payment has been authorized, cleared, and an official e-ticket number has been generated.

5. Passports, International Visas, and Health Entry Rules

• Passport Validity: For all international travel departures from India, your passport must be valid for at least six (6) months from your scheduled return date and contain empty pages for stamp placement.
• Transit & Entry Visas: You are strictly responsible for obtaining all mandatory tourist visas, electronic travel authorizations (eTAs), or transit visas required for your entire route. Many multi-city layovers require transit visas even if you do not step outside the airport terminal.
• Denial of Boarding: If you are denied boarding or entry by airline crew or foreign border authorities due to inadequate visa paperwork, all cancellation penalties and return travel costs remain entirely yours to bear.

6. Payments, Cancellations, and Administrative Refunds

A. Supplier Rules Overriding

All itinerary modifications, cancellations, and refund options are bound entirely by the raw Fare Rules of the booking airline or hotel. Promotional fares are often designated by carriers as non-changeable and non-refundable.

B. Agency Processing Fees

In addition to the penalties applied directly by the Travel Providers, The Flights Guru levies a standardized, non-refundable administrative fee per passenger for handling post-booking changes or processing authorized refunds. All payment gateway fees and convenience charges collected at the time of booking are completely non-refundable.

C. Refund Delivery Windows

Refund credits are returned back to the exact payment method used during the original transaction. While domestic airline refunds clear quickly, international routing refunds must navigate global clearinghouses and can take between 30 to 90 days to settle into your bank account.

7. Legal and Financial Compliance (India)

Mandatory Regulatory Highlights

Flights Guru Services Private Limited operates in complete alignment with Indian financial and data protection laws:

• Tax Collected at Source (TCS): In compliance with Section 206C(1G) of the Income Tax Act, 1961, all overseas travel remittance and holiday package transactions require a valid traveler PAN card and are subject to mandatory TCS collection. This cannot be waived or altered by our agency.
• GST Invoicing: To claim your corporate Input Tax Credit, a valid GSTIN and business billing address must be supplied at the exact moment of booking. Retroactive GST additions post-ticketing are legally impossible.
• Data Privacy Rules: Your personal data, financial details, and passport images are heavily encrypted and managed in accordance with the Information Technology Act, 2000 and India's data protection rules.

8. Limitation of Liability and Force Majeure

A. General Liability Cap

To the maximum extent permitted under applicable law, The Flights Guru and its directors, employees, or affiliates shall not be liable for any direct, indirect, incidental, or consequential losses resulting from your use of this Platform. Our total aggregate liability for any proven claim tied to a booking is strictly capped at the direct administrative service fee earned by the Company for processing that transaction.

B. Force Majeure Protection

We are not liable or contractually in breach for any delays, route variations, or non-performance resulting from a Force Majeure event (events outside our reasonable control). This includes earthquakes, typhoons, structural airline bankruptcies, airport closures, acts of war, terrorism, civil unrest, strikes, or pandemics and accompanying government-mandated travel bans.

9. Governing Law and Exclusive Jurisdiction

This User Agreement, your access to our services, and all claims arising out of your transactions shall be governed by and interpreted strictly in accordance with the laws of India.

You explicitly agree that any legal dispute, controversy, or lawsuit filed against the Company or its directors shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.

10. Modifications to This Agreement

We reserve the right to modify, amend, or restructure this User Agreement at any point without prior individual notifications. Updated agreements take effect immediately upon being posted on this webpage. Your continued use of our platform or booking services after an update denotes your explicit, binding acceptance of the modified terms.
